SURROGACY
Surrogacy is not a simple process. To the contrary, it's complicated. Although its a personal journey, it's a legal, medical, social and emotional process. It’s a unique partnership between hopeful parents and surrogates.  It’s a collaborative effort between them and their legal, medical and surrogacy professionals to bring a new life into the world.

If you’re new to surrogacy, whether as a prospective surrogate, a hopeful parent, or just someone who is interested in learning more about the various ways a family can be built, it can be difficult to know where to start. We're here to help you in any way possible!

Types of Surrogacy

There are two types of Surrogacy…Gestational and Traditional

In traditional surrogacy, a surrogate mother is artificially inseminated by the intended father or an anonymous donor. The child is therefore related to both the surrogate mother, who provides the egg, and the intended father or anonymous donor. This complicates the process and gives the surrogate the right to challenge her parental rights to the baby after the baby is born.  Many states prohibit Traditional Surrogacy Agreements.

In gestational surrogacy, an egg is removed from the intended mother or an anonymous donor and fertilized with the sperm of the intended father or anonymous donor. The fertilized egg, or embryo, is then transferred to a surrogate. The child is genetically related to the woman who donated the egg and the intended father or sperm donor, but not the surrogate. Intended parents are those people who have tried for years to conceive and have a biological child naturally.  For many different reasons, they were unable to do so.   Some families have even tried IVF. They so longed to be parents that they researched and learned that surrogacy was another way to achieve their dream.

Clients of Creating an Angel, will be matched to the perfect Surrogate! You will be able to view profiles of approved Surrogates who are compassionate and understand the importance of confidentiality.  Both our Surrogates and Intended Parents have gone through the arduous screening process and have been approved and ready to begin the process. Our staff and colleagues are open, honest, and compassionate.  Each of our clients is unique with their own individual needs.  We will explore your options with you and devise a plan that’s yours and yours alone.

Intended parents can include couples and single people; there is no “typical” intended parent.

  • Single men who want a child
  • Single women who cannot carry a child to term themselves, due to infertility or health risks
  • Same-sex female couples who cannot carry a child themselves
  • Same-sex male couples
  • Medically unable to have children
  • For Florida Statute 63-213 information on single parenting and Pre-Adoption Agreements through surrogacy
NOTE:  LGBTQ singles and single men and women are eligible to use a Surrogate; however, they would enter into a pre-adoption agreement and file a petition to adopt after the baby is born.  A partner will adopt the baby after the Intended Parent has finalized the adoption. Through Assisted Reproductive Technology, the LGBTQ community are now able to have a genetic connection to their child.

While intended parents who are older are more likely to struggle with infertility, many intended parents are younger as well.

Intended Parent Requirements

  • Be between the ages 21 and 50
  • Complete all necessary paperwork
  • Be respectful of the Surrogate’s commitment
  • Be in a stable living situation
  • Proof of financial stability (Previous Tax Return/Pay Stubs)
  • Not on any public assistance
  • Be willing to undergo a Psychological Assessment
  • No criminal history…Able to pass a background screening
  • Have the support of your spouse or partner (if applicable)
  • Have read and understand the Surrogacy process

With Gestational Surrogacy in Florida, couples do not need to "adopt" their child and will not need to attend Court. There are no residency requirements as well.

The Legal Requirements

You will meet with your attorney to discuss your legal rights, compensation and risks.

  • Both you and the surrogate will express your needs to your individual attorneys.

  • Your legal rights and compensation for the surrogate will be specifically stated in the contract.

  • The attorneys will draft a contract that accommodates the needs of each the Intended Parents and the Surrogate.

When both parties are in agreement, the contract will be signed by both the Intended Parents and the Surrogate.

After the first trimester, your attorney will work with you to establish you as the legal parents of your child. You will make medical decisions for the baby and your names will be on the baby's birth certificate. This is the pre-birth order declaring the child as legally yours.

The Embryo and Fertilization Process

Medical procedures can begin!

  • The fertilized egg will be transferred to the surrogate.

  • The surrogate receives fertility treatments, blood tests, ultrasounds and medications, as needed.

  • The surrogate receives prenatal care and schedules her routine medical appointments.

  • It's time to birth your child!

* The surrogate begins receiving compensation after the heartbeat is heard.

Cost of Surrogacy

CAA is committed to keeping costs as low as possible through strategic partnerships and financing options for singles, heterosexual and LBGTQ individuals and couples in the United States.  We understand that the cost of surrogacy can be challenging!

We try to help our clients identify various organizations that can assist in the financial part of the process with hopes to help fulfill their dream.  These are some institutions that may be options for you.  Contact each one to determine if any are right for you and choose the one that best suits your individual needs.  We have other institutions as well.  There are many!

Professional Fees



NOTE:  There are medical expenses and some other surrogacy expenses that are tax deductible.  Please check with your accountant to learn more!
In addition, donations may be tax deductible if a PLR (Private Letter Ruling) is obtained from the IRS.

Some insurance companies do pay for In Vitro Fertilization.  Check with your insurance company to find out if your company will cover your surrogacy pregnancy.  Certain insurance companies include a specific clause in their plans that excludes medical coverage for surrogate pregnancies.

IVF Process

This is an overview; however, every clinic’s schedules may vary slightly.

Week 1:      

  • Consultations:  Initial, Treatment Plan, and Financial

Week 2-6:   

  • Pretreatment (blood tests, ultrasounds, infectious disease screening, uterine evaluation, male fertility testing);

  • Beginning of Birth Control Pills

  • Medications, Monitoring with Ultrasounds and blood tests.

Week 7: 

  • Triggering the final maturation of the eggs;
  • Ultrasound egg retrieval;
  • Egg and sperm are combined in the lab;
  • 3-6 days after fertilization, embryos are evaluated for transfer;
  • 3 days after fertilization, embryos are ready for transfer into the uterus.

After IVF, progesterone supplement is taken to help support the uterine lining and encourage implantation.

About 12 days after the embryo transfer, a first pregnancy test is given.  If the test is positive, a repeat test will be taken about a week later to confirm pregnancy.  An ultrasound will be given 2 – 3 weeks later.

At this point, in most situations, you will be transferred to your OB GYN.

Embryo Donation?

Embryo donation is a third party reproduction.  It’s the implantation of another woman's embryos to the uterus of a woman to facilitate pregnancy and childbirth in the recipient. In Gestational Surrogacy, the child is legally considered the child of the Intended Parents.

The donation of eggs, sperm and embryos are governed by Florida Statute 742.15. The statute specifically provides that the donor of any egg, sperm or embryo (except when specified) shall relinquish all maternal or parental rights and obligations with respect to the donation or the resulting child(ren).

All families have their own unique ways of resolving situations that come up in their lives. Because they're all different, they accommodate their needs in the best way possible.  Longing for a child in  their lives is no different.  With modern technologies, their are other options they can choose from.  Researching and becoming knowledgeable of what's available is the first step.  Embryo donation is one of them.

So many couples undergo in-vitro fertilization to conceive a child through Embryo Donation.   Very often women have embryos (egg and sperm joined together) that are not used.  Sometimes they store the frozen embryos for future use.  Other times, when they have completed their families they will decide to donate the remainder of unused embryos to another infertile couple.  Because the family has already had children, the indication of embryo viability is good. With so many options to choose from, deciding on your own personal road to parenthood can be overwhelming at times. The surrogate only needs  the ability for the embryo to transfer into her uterus and to carry a pregnancy to term.

1. Embryos donated by another infertility patient are often less expensive.

2. Embryo donation maintains no genetic connection between the surrogate and the child.

3. Some donation programs will allow the Intended Parents to utilize all the embryos from one woman so the Intended Parents children will be genetically linked.

4. Families sometimes like to be in touch with one another. Some embryo donation programs do facilitate sharing information between families.

A frozen embryo transfer is a fast procedure that takes about 15 minutes.  Between checking in, having the procedure and resting after, the visit is under 2 hours.  The procedure is performed under careful monitoring and preparation of the lining of the uterus (endometrium), ready for the transfer of frozen embryos.

Women 35 years and younger have over a 60 % chance of pregnancy per transfer.

The first ultrasound performed for determining the time of transfer of the embryo is usually performed on day 10-12 of the surrogate’s cycle. When the endometrium is thick enough and of the right maturity, a trigger injection is given to better effect ovulation and to change the endometrial receptivity. The embryos are then thawed for transfer.

As far as medical experts know, frozen embryos remain viable indefinitely and records indicate a successful transfer was done at 24 years.

While embryo donation is not for everyone, it can be an opportunity for many who have given up hope of empowering their lives with a child.
